Truck Accident

Monday, June 7th, 2021

Our Miami Truck Accident Attorneys Are Eager to Help!

It’s a sobering fact. Florida, especially South Florida, is among the national leaders in deadly truck crashes ( and truck wrecks in general ).

Unfortunately most victims in tractor trailer, 18 wheeler accidents are the drivers and passengers of smaller 2 axle vehicles like cars and pick-ups. This is because commercial vehicles often weigh 20-30 times more than passenger vehicles and are taller with greater ground clearance. This can result in smaller vehicles under riding trucks in crashes.

Injured by a Truck? In a Hurry About YOUR Case? Have Questions?
The attorneys at A to Z Injury Law are ready to answer any question you might have regarding your case or potential case, A to Z! +(305) 677-8325.

Because of our close proximity to Miami’s commercial center and PortMiami, the truck accident injury lawyers here at A to Z Injury Law see first-hand how devastating these collisions are to victims and their families in the Metro-Dade area and throughout the state. We’ve helped injured victims win substantial settlements from insurance companies in this arena. We have the case results to prove it!

PortMiami, recognized as the “Cargo Gateway of the Americas” and the preferred shipping gateway to Europe, the Middle East, India and Asia. Each year millions of tons of products come in and out of this South Florida port in Biscayne Bay and most of them will go on or off a truck in the process.

Commercial drivers are almost always at fault in truck accidents, although their insurance companies regularly try to argue otherwise. Statistics provided by the Insurance Institute for Highway Safety confirm that the most common causes for crashes is truck braking capability, reckless distracted driving and driving while fatigued or overtired.

FACT: In 2018, Medium/Heavy Trucks (more than 10,000 lbs) were involved in over 31,600 accidents in Florida! Light trucks accounted for over 6,000 more collisions.

Commercial trucking companies regularly ignore mandatory safety regulations but are rarely held fully accountable for their actions. It takes an experienced truck accident lawyer to gather evidence and conduct the necessary research to prove that a commercial trucker was at fault for violating safety regulations. At A to Z, our experienced injury attorneys work tirelessly to secure justice on behalf of crash victims and their families either by securing an adequate settlement or going to trial.

Our attorneys understand that trucking and logistics companies must be held liable for their actions, not just for the sake of our clients but for the greater good of the public.

We are here to help. We would be happy to answer ANY question, A to Z, regarding your personal injury or that of your loved one.
Call +(305) 677-8325 or click here for help, 24/7. Hablamos Español.

Statistics show that most truckers are not well-rested and fail to take public safety into consideration by violating traffic laws and safety codes that are created to maintain the well-being of innocent people on the road.

If you or a loved one has been injured or killed in a trucking accident in Miami or anywhere in South Florida, it is essential to consult with an experienced accident injury lawyer who has experience with these types of cases and who is willing to do more than settle with the insurance company for a first or second offer. Miami’s Top Spinal Cord Injury Lawyer

We’re Here to Help You Win Your Lawsuit!

The spinal cord consists of many nerves that carry messages between the rest of the body and the brain. Spinal cord injuries mainly occur because of a traumatic injury resulting in a partial tear, transection, or contusion in the spinal cord most often caused by car, truck and motorcycle accidents as well as sports injuries, the effects of this type of damage can lead to death in children, permanent disability, broken neck, broken back, back injury and substantial financial losses

However, since many spine-related injuries result from trauma caused by accidents, you might be eligible to sue for significant monetary damages that can help you now and far into the future.

Call our accident attorneys here in Miami to learn how you can file your personal injury case properly. Our spinal injury lawyer team includes Ruben Chavez and Erik Alvarez, with years of extensive experience in conducting these types of cases for Miami area victims.

Roots of Spinal Cord Injuries

The causes of spinal cord injuries are many, and the results of the damage vary greatly. A spinal cord damage can result in broken back, broken neck, back injury and other complicated issues. These injuries often change the strength, body function, and sensation around the injury area. Below are the most common causes.

Auto Accident, Acts of Violence, and Falls

According to the American Association of Neurological Surgeons, these are the three most common causes of spinal cord injuries. Auto accidents and motorcycle wrecks are the top leading sources of spinal cord injuries for people below 65 years old. Nevertheless, slip and falls are the top-most leading causes of spinal cord injuries for individuals 65 years and above.

Sports Injuries

Approximately more than 80% of sports-related spinal cord injuries testified do involve men. These injuries are common to sports that involve the risks of falls and physical contact. These activities include rock climbing, horseback riding, snowboarding, and skiing.

Medical complications

This is the most common source of spinal cord injuries in females. However, if the damage is because of mistake or negligence, the patient might acquire a misconduct claim against the medical providers.

Symptoms of Spinal Cord Injuries

The ability to control your muscle limbs after a motor accident that results in spinal cord damage depends on two factors: the severity of the damage and the injury’s location. It is good to note, at times, you might find it difficult to notice a spinal cord damage immediately. For example, during an auto accident, a victim may experience soft tissue injury or dislocated vertebrae. However, the patient might not experience the symptoms right away but might develop stiffness and pain after a few weeks or days. Failure to pay attention to the signs can aggravate the injury-causing more damage.

Symptoms of spinal cord damages include:

  • Sensation or loss of mobility
  • Difficulty in breathing
  • Exaggerated reflexes
  • Lack of balance and coordination
  • Failure to feel heat and cold

If you have the above warning signs, ensure that you contact a medical expert. It is always essential to seek treatment after an accident. If you fail to seek medical treatment, you can jeopardize your health and endanger a personal damage claim if another person instigated your injury.

Why you Need a Spinal Cord Injury Attorney

The major problem Miami’s spinal cord damage victims face with acquiring a fair compensation is that most accident attorneys tend to experience a difficult time proving the injury’s extent. Generally, this is a technical process and requires a spinal cord injury attorney who perfectly understands this realm, including the terminologies.

Call A to Z Injury Law in Miami

Wrongful Death

Miami Wrongful Death Attorneys

When a loved one dies, most people are understandably consumed with grief rather than worrying about filing a lawsuit. Eventually though, the expenses associated with a loved one’s death and the harassment by creditors about those bills become a painful reminder of how unfair and devastating wrongful death can be. To make matters worse, wrongful death claims are notoriously difficult to prove and require expert legal representation to secure a sufficient settlement or verdict.

A to Z Injury Firm is a Miami based personal

injury law firm committed to protecting the rights of our clients and their loved ones. Our wrongful death attorneys have spent years handling the burden of wrongful death claim negotiations and legal battles so families can focus on grieving the loss of their loved ones without the extra stress of worrying about statutes of limitations expiring, which is 2 years for wrongful death according to Florida Statue 9.511(4)d. Wrongful death can result from catastrophic car accidents, medical malpractice, nursing home abuse and neglect, criminal behavior, chemical exposure, workplace accidents, and several other causes.

Question about a wrongful death case? Call (305) 677-8325 ‘Ask Us Anything… A to Z!

If an individual or company acts recklessly or negligently, and those actions have led to a death in your family, you will want to consult with an attorney who specializes in handling cases such as yours. The sooner a lawyer can begin collecting evidence to prove that your loved one’s death was the fault of another, the sooner you can begin to heal from the nightmare of your family member’s passing. Under Florida law, wrongful death claims typically are made for pain and suffering, loss of companionship and the value of lost support. In addition, the state generally allows claims for damages incurred when the injury occurred to the point of death, plus interest, in addition to projected future earnings. According to the Center for Disease Control, accidents account for more than 160,000 wrongful deaths each year. The Bureau of Justice Statistics reports that juries hear more than 2,500 malpractice-related wrongful death cases annually. Many more settle before going to trial, and a number of Florida wrongful death cases are never known by family members to have been the fault of another person. If you have lost a loved one in South Florida, you can consult with one of the experienced wrongful death attorneys at A to Z free of charge. Our lawyers work on contingency, meaning that we do not collect any payment from our clients unless we secure justice in their favor.

Motorcycle Accident Injuries

Common Types of Biker Accident Injury in Miami

Few things compare to the feeling of riding a motorcycle, and few places in the world offer riders the scenic beauty and fair weather Miami does. The sense of freedom that comes from cruising roads like Ocean Drive on your Ninja or the Florida Keys Scenic Highway on your Harley Davidson is one of the many reasons bikers are drawn to ride in the Sunshine State.

Freedom comes at a price, though, and for motorcyclists, the price is increased exposure and a higher likelihood of being injured in an accident.

If you or someone you know has been in a wreck, they need to speed with a Miami motorcycle accident lawyer as soon as possible!

Whether riding a Harley cruiser, a Kawasaki street-bike, or any other make of cycle, a biker always needs to be aware of his or her surroundings. No matter how careful a rider is, though, there is no accounting for the negligence of other motorists, especially during drive time in Miami. In fact close to ¾ of all biker collisions involve a passenger car!

Motorcycle Accident Injury? In a Hurry About YOUR Case? Have Questions?
The attorneys at A to Z Injury Law are ready to answer any question you might have regarding your case or potential case. Ask Us Anything…from A to Z!  Call (305) 677-8325  or click here.

Here Are the Most Common Biker Injuries Our Attorneys See in Miami

Road Rash

One of the most common threads throughout all wrecks is road rash. These skin abrasions caused by the scraping off of layers of skin on pavement involve sharp pain and painful recovery. They can even require skin grafting in severe cases. It’s also vitally important to treat the wound with proper wound care techniques in order to prevent infection and scarring.

Broken Bones / Fractures

Broken bones are among the most common injuries sustained in motorcycle accidents. While a broken arm, leg, or even clavicle (collar-bone) may not seem as severe as a head injury or paralysis, such breaks can lead to chronic, long-term pain. As this can lead to difficulty making a living and decreased quality of life, broken bones should be taken very seriously.

Did you know? According to the National Institutes of Health riders over 50 years old are more likely to ride larger bikes, and were more involved in overturns or collisions involving striking highway poles, protective barriers and other structures?

Injured Back and Neck

Thoracic injuries are the most common form of injury suffered by older bikers, according to the NIH. A wipeout at high speed can twist your body into positions that not even a contortionist can easily withstand. Lower back, upper back and neck injuries can be treated and can even completely heal these days with help from back physicians and surgeons, neurologists, pain management doctors, and chiropractors, but these injuries require a lot of therapy and can take years to heal. That is why you should try to get as much monetary compensation for your case as possible.

Shoulder and Rotator Cuff

Rotator cuff injuries are common in bike wrecks; unfortunately, they are not always given the attention such an injury deserves. Bikers, as a whole, are a tough breed, and some tend to shrug such injuries off as minor. The truth is, rotator cuff injuries left untreated can result in chronic, long-term pain.

Motorcyclists need to understand rotator cuff injuries are serious. They should be treated immediately, and often require time to heal. Riders who’ve sustained a rotator cuff injury should contact one of our motorcycle accident lawyers as quickly as possible.

If you or someone you love is injured in a motorcycle crash in Miami, contact our law office right away. You can ‘ask us anything’ about your particular situation whether your accident just happened or even if you have retained the services of another attorney and you have a case underway. We’d be happy to offer you a complimentary consultation.

The pain of injuries sustained in a wreck is hard enough to withstand. Don’t add to your stress by worrying about how to pay the medical bills, how to make up lost wages, and how to deal with the insurance company. Instead, contact our motorcycle accident lawyers. We will help you throughout your ordeal, from choosing the right doctors to dealing with the insurance claims to finalizing your Settlement.

Head and Brain Injury

Unfortunately, head and brain injuries are commonly associated with motorcycling accidents. Many motorcyclists still refuse to wear a helmet, even though helmets reduce the risk of head injury by 69 percent and reduce the risk of death by 42 percent according to SafeRoads.org. Any wound to the head should be taken seriously and looked to immediately. What may seem a slight injury at first could wind up resulting in memory loss, concussion, and even severe brain trauma.

In the case of head or traumatic brain injury (TBI ), immediate medical attention and proper rehabilitation are a rider’s best hope of minimizing damage. Of course, such treatment is expensive. An experienced motorcycle accident attorney like Erik Alvarez can ensure you are awarded the compensation you or your loved one deserve, compensation that will mitigate the high costs of hospital stays and rehabilitation.

Spinal Injury / Paralysis

spinal injury is life-altering, not only for the injured rider but for his or her family and friends as well. Paralysis such as paraplegia and quadriplegia require rehab, physical therapy, and often nursing care. Such services do not come cheap in Miami, or anywhere else. Bikers who suffer spinal injuries should work with an attorney like our own Rubn Chavez, who knows how to make sure such expenses are not be paid out-of-pocket.

Nursing Home Abuse And Wrongful Death Lawsuits

Wednesday, April 21st, 2021

Nursing home abuse in South Florida is a serious matter. Each year thousands of seniors are injured or even killed in nursing homes across the country. A study by the University of South Florida says that “Between 1 and 2 million Americans 65 and older have been injured, exploited, or otherwise mistreated by someone on whom they depended for care or protection.”

Seniors come to Miami for the tropical climate and relaxed lifestyle. This is also why many families choose it as the choice location for assisted living facilities. We entrust assisted care facilities with the life and well-being of our senior family members. Nobody expects that they would turn a blind eye when such an atrocity occurs. Even worse is when you discover that they tried to cover it up.

A to Z Injury Law attorneys are experts in the field of nursing home abuse. We will make sure the guilty pay for their crimes by ensuring you and your loved one are justly compensated.

Examples of senior abuse in nursing homes.

A common example of senior abuse is that of a nursing home patient who had a heart attack and died. In this type of situation, the patient’s family may decide to sue the facility. The first thing you will want to do is get a professional nursing home liability attorney to assess your case.

Your best-case scenario may be a suit against the homeowner or operator of the home. If you win the suit, you may be able to collect compensation for medical bills, funeral expenses, and loss of income.

Suffering an injury while in someone’s care could be another example of nursing home abuse. In this instance, the family of the patient may decide to press charges against the facility. You’d have to prove the injury was due to negligence on the part of a staff member, facility, or both. These suits can be costly but with the right attorney, you can receive compensation for injury, pain, and suffering.

Another common scenario is that of a nursing home accident. In these instances, the patient’s family may decide to file a lawsuit in an attempt to get their deserved compensation. Nursing home lawsuits are very common because most of these victims do not receive voluntary compensation from the facility.

Many victims of nursing home abuse suffer long-term psychological effects from their experience. This is why so many families opt to pursue a legal case through a nursing home lawsuit. It is not the physical injuries and pain that must be addressed. The effects of mental trauma and anguish are something that can last a lifetime.

Types of compensation available for victims of senior abuse in Miami.

If a loved one has experienced a wrongful death in a nursing home, there are several ways to obtain compensation. One way is through a wrongful death lawsuit. Another is through a medical malpractice claim. There are also other options available such as a financial lawsuit or a class action.

A wrongful death lawsuit can be filed either by the patient or by anyone related to the patient. If you or a loved one have been harmed by a doctor, you should contact a wrongful death or medical malpractice lawyer. They should offer a free consultation to help you decide if it is worthy of pursuing.

Medical malpractice is another way to file a wrongful death lawsuit. These suits can also be filed by relatives who have died because of medical negligence. This type of suit can be difficult to prove, so it may not always be successful. A skilled attorney may be able to make it a strong possibility.

The team at A to Z Injury Law is available 24/7 and is committed to protecting our great Miami seniors from neglect and abuse. Click here for a free consultation.

Car Accidents That Result In Death May Qualify For A Wrongful Death Lawsuit.

Thursday, April 15th, 2021

Wrongful death car accidents happen way too often in Miami and we’re no stranger to the devastation they cause.

Fatal accidents caused by the negligence of another party, such as drunk or reckless driving may be eligible for a wrongful death lawsuit, and that’s where we come in.

A to Z Injury Law attorneys are dedicated to helping families recover from wrongful death car accidents.

The streets of Miami are flooded with cars every day. Driving from Little Havana to downtown Miami on Flagler Street is bumper to bumper. South Dixie Highway is full of people in a rush, swerving in and out of traffic and it’s pretty much the same everywhere you go here in South Florida. While most accidents are preventable, you could still end up in some kind of car accident at no fault of your own.

Anyone driving through the streets of Miami owes a duty of care to everyone on the road. Not just to other drivers, but to motorcycles, pedestrians, and bicyclists as well. Anyone who doesn’t follow the traffic safety laws in South Florida should be liable for the consequences of their actions. But in order to seek justice, the family of a victim in a fatal car crash must be able to prove the other driver was negligent.

Some examples of negligent driving are:

  • Drunk driving
  • Speeding or driving too slowly
  • Running a red light or stop sign
  • Distracted driving – talking or texting on their cell phone
  • Failure to use their turn signals
  • Driving without a license

A to Z Injury Law specializes in wrongful death accident law. We have a proven track record of securing settlements and verdicts on behalf of victims.

Car Accident Facts And Statistics In Miami.

Dade County is home to many different types of car accidents. From simple fender benders to fatal crashes, South Florida is no stranger to them.

The Florida Department of Highway Safety and Motor Vehicles (FLHSMV) conducted a survey in 2018. Below is a list of some of the data from that traffic crash report for Miami-Dade County. (Source: FLHSMV Crash Dashboard)

  • 64,627 crashes occurred
  • 273 crashes resulted in death
  • 30 fatalities involved a hit and run driver
  • 45 deaths involved motorcycle riders
  • 107 pedestrians died
  • 20 people riding their bike died

Wrongful Death Car Accidents Require Experienced Lawyers To Handle Your Case.

You should never leave the results of a wrongful death car accident in the hands of an insurance company. Their goal is to simply resolve the claim as inexpensively and quickly as possible. They will surely not take into consideration the emotional cost of dealing with your loved one’s death. They will also try to limit the money you are entitled to regarding financial burdens associated with a fatal car accident.

Miami car accidents involving a wrongful death should be handled by knowledgeable legal counsel. It is essential you consult with the right attorney before dealing with an insurance company. The costs involved in the death of a loved one are many. Medical bills, funeral costs, loss of future income, and pain and suffering should all be considered.

We Can Help

We have helped hundreds of clients get millions of dollars in recoveries, and we are prepared to fight for your rights.

What to Expect During the Initial Consultation with Your Injury Lawyer

Wednesday, April 7th, 2021

Before you hire a personal injury attorney in Miami, it’s important to meet with them for your initial consultation. During this meeting, you can determine if this attorney is right for you, build rapport, and discuss details of the case. There are some things you probably already know about preparing for this consultation and won’t need much help with.

For example, you know to arrive promptly and dress professionally. But what else goes into an initial consultation?

What should you ask?

Here, we discuss how best to prepare for the initial consultation to make it successful – whether your initial consult is with A to Z Injury Law

What to Bring:

Make sure you have something to take down plenty of notes, whether it be a laptop or a pad and pencil. It’s also helpful to go into the meeting with a list of questions prepared. Reviewing the attorney’s website beforehand for basic information is helpful and certainly advised, however it doesn’t provide detailed background information about the attorney. So, gather a list of detailed questions, such as:

  • How many cases have you handled like mine?
  • What is the average verdict you obtained in cases like mine?
  • How long have you been practicing law in this county?
  • Will you be the one handling my case? Will other attorneys be involved in the case?

It’s also good to know how quickly the attorney will respond to your questions throughout the case. Ask how often you will expect to hear from the attorney, and whether he/she will frequently update you on the case proceedings.

While you ask questions, this is a good time to get a sense of what the attorney is like. Is he patient with you? Does he make it seem like your time is valuable? Does he seem invested in your case? If you answer “no” to even one of these questions, you may want to consider finding another attorney to represent you.

At A to Z Injury law, we understand there are many elements involved in handling a client’s case. While our goal is to maximize our client’s recovery, we are also committed to helping with all their issues – big or small. We work to ensure our patient’s lives are easier following an accident.

During the consultation, bring copies of documents that may be relevant to the case. For example, landlord-tenant disputes are common in Miami. If you are in a dispute with your landlord, bring a copy of your lease or a demand letter for the return of your deposit. If you don’t have documents, bring other material that may be pertinent to the case. For example, if you were involved in a car accident while crossing the intersection at US 1 in the Coral Gables area, bring copies of the crash report and any pictures you may have.

Before going into the initial consultation, ask if you will be charged a fee. If there is a fee, make sure you have adequate payment to cover it. At A to Z Injury Law, we offer a free consultation and case review.

Discuss the Legal Plan

After going over the details of the case, ask the lawyer if he or she has a strategy in mind for winning your case. Find out how long before cases like yours are typically resolved, and whether there is a possibility of it going to court. Many cases can be resolved outside of the courtroom and many of them are. However, if the case does go to trial, does your attorney feel confident defending you in the courtroom?

It’s important to discuss the legal plan during your initial consultation. That way, you know whether you are on the same page or not.

Learn the Fee Structure

You should always discuss the legal fees during the initial consultation. This is different with every lawyer. Find out if they plan to charge you by the project, on a contingency basis, or by the hour. In general, if an attorney charges you by the hour, he/she will ask for a retainer up front and then bill you hourly going forward.

Also, find out when you will be charged: quarterly, monthly, up-front, or at the end of the case? Will there be multiple attorneys on your case? If so, will they bill you at different rates? If money is a concern, find out if there is a payment plan.

How to Find a Personal Injury Lawyer That Can Help With Your Case

Friday, March 26th, 2021

If you’ve recently been injured, finding a lawyer to represent you may be a daunting affair, however, it’s one that shouldn’t be taken lightly.

Don’t pick the first attorney who comes up on your search or the attorney with the most TV commercials. At A to Z Injury Law, we know the mistakes clients often make and want to guide you into making the best decision.

Even though you have many lawyers to choose from, you want to find someone who is specifically experienced in personal injury law. That should be your first step (we’ll get into more detail on that). Then, follow the steps below to ensure you find the best person to advocate for your rights.

Find a Personal Injury Lawyer

Hire an experienced personal injury lawyer who can get you a large settlement to cover all your medical expenses and additional compensation for pain and suffering.

Personal injury law is very detailed, so hiring just any lawyer isn’t going to cut it.

If your lawyer isn’t experienced in this area, you may be more knowledgeable than your lawyer. The personal injury attorneys at A to Z Injury Law are experienced in both large and small cases. We know how to help clients after they’ve had an accident that resulted in injuries.

If you cannot contact our law firm because you live outside of Florida, find a lawyer you can trust and who has the experience to professionally guide you through these trying times.

Additionally, you should do your research to ensure your lawyer does not have years of experience in unrelated cases. In general, an attorney who specializes in personal injury law will have a more in-depth perspective and will be better suited to help you get the results you want.

Review Your Attorney

One part of researching your attorney is making sure they’re in good standing with their state and local bar association. Usually, you can get access to referral lists at many of the larger bar associations to find this information. You can also review lawyer directories, which often provide extensive information on the attorney, including client reviews and peer ratings.

Contact the Attorney

Sometimes, the best way to know if the attorney is right for you is to contact their office and evaluate your experience with them. If they took too long to return your call, if the receptionist was rude or impatient, and if you never had the chance to even speak to an attorney, then it’s time to look elsewhere.

Contacting the office can provide valuable insight into how well they treat you and handle your case.

Ask Questions

After you’ve narrowed down your list to a few lawyers, you should call them and ask questions. A few questions you should ask before hiring a lawyer include:

  • How many of their cases are referrals?
  • What kinds of cases do they typically handle?
  • How many cases have they taken to court?
  • How long have they been handling personal injury cases?
  • How many cases are they currently handling?

If you live in Miami and have questions related to your case, or would like a free consultation, contact A to Z Injury today. It’s easy to make mistakes when you don’t have the guidance of a professional attorney.

Common mistakes include posting about the accident/injury on social media, not filing their claim on time, and not including the proper documentation. Our lawyers will help guide you through the entire personal injury process and make sure you are fully compensated for your injuries.

Your Lawyer Shouldn’t be Afraid of Courtrooms

Make sure your lawyer has experience taking cases to trial. This may sound obvious, but some lawyers have never stepped inside a courtroom. Instead, they expect their client to accept the first settlement offered by overly aggressive insurance companies. Make sure your attorney can take your case in front of a judge if need be.

The attorneys at A to Z injury law are trial lawyers who aren’t afraid to battle it out in the courtroom to maximize your recovery.

Medical Malpractice Law

Monday, June 7th, 2021

Miami’s Top Medical Malpractice Attorneys

Medical malpractice lawsuits can be among the most difficult personal injury or wrongful death cases to win for a variety or reasons, and particularly against physicians.

Medical facilities are often negligent in the manner in which they care for patients because they work in teams in many instances and communication breakdown can happen when all workers are not properly informed or lack certain expertise.

The size of the hospital does not necessarily indicate the ability of the staff, and injuries can occur to patients at larger facilities such as Mercy Hospital, Jackson Hospital, Baptist Health of Miami, or even Mount Sinai Hospital.

Mistakes happen in treatment practically everywhere that patients are admitted in the Miami area, and being properly compensated for those mistakes requires experienced and knowledgeable legal representation by malpractice lawyers who understand the medical technology involved, the terminology and Miami area law, judges and insurance companies. These are assuredly not simple general lawsuits on any level.

Startling Statistics

There are some startling statistics concerning medical malpractice lawsuits across the United States, and the state of Florida is near the top of the list for cases filed and reparations paid.

According to NPBD data, Florida ranks third during the years of 2009-2018 with a total claim payout of $2.488 billion in compensation for almost 11,000 cases, Florida follows only New York and Pennsylvania. The highest point of the amount of payout was registered in 2018, which means that people are realizing that they do have a recourse when a doctor or treatment facility they trusted with their care fell short of the professional mark they advertise.

Why You Need a Dedicated Medical Malpractice Lawyer

Medical malpractice is a wide field of law that many attorneys do not necessarily understand as in depth as an lawyer who has dedicated a portion of their practice to this particular area. You need someone with an in depth understanding of not only law, but of medical procedures, anatomy and healthcare technology. There are many forms of medical treatment, and cases against negligent medical professionals can include malpractice issues with:

  • Dentists
  • General Internal Physicians
  • Specialist Physicians
  • Physical Therapists
  • Surgeons
  • Treatment Facilities
  • Psychologists
  • Nursing Homes
  • Long Term Care Facilities
  • Assisted Living Facilities
  • Birth Specialists
  • Medical Device Installation Technicians

Problems can arise and injuries occur when any one of these categories of medical treatment workers make mistakes in prescribing medications or treatment regimens.

While most healthcare specialists will follow the recommended treatment, protocols or medical defense initiatives, some doctors and facilities will opt for unusual treatment recommendations that do not meet established guidelines.

Question about your personal injury?Call  (305) 677-8325  ‘Ask Us Anything…A to Z!

Failure to follow reasonably recommended treatment guidelines is a component of many ‘med mal’ cases, and having a comprehensive Miami medical malpractice lawyer on your side who is well-versed in these guidelines means that your case can be properly investigated while being crafted for presentation to the court or insurance provider.

Potential Damages

The range of remedies for compensation in this type of lawsuit is very similar to other personal injury cases, but the degree of negligence and extent of injury are the primary factors in the final outcome of a case.

Not only can legal expenses be recovered, but injured victims can be reimbursed for medical bills, lost ability to work, and long-term damage as a result of the injury.

Cases such as a child birth injury or a surgical mistake can be extensive because they can impact the remainder of the victims life. General damage amounts are usually what actually makes the injured plaintiff financially whole after the fact, and it takes an experienced medical malpractice attorney to itemize the potential problems the patient will face going forward in life. And when a case is the result of a death in treatment, punitive damages can even apply in certain egregious instances.

A to Z Injury Law – “We’re With You…All the Way!”

Always remember that details in treatment matter greatly when a medical malpractice case is being processed, and the attorney you choose matters greatly as well. These are highly specific claims and attorneys must know the ropes of the medical industry to understand where to investigate in establishing a case. This is why it is vital to have an aggressive and seasoned Miami medical malpractice attorney who can craft a case for maximum financial recovery by pinpointing all of the negligence factors involved in causing the injury.

We Help Accident Injury Victims

Our Miami auto accident lawyers were able to secure a $2,000,000 ( 2 Million Dollar ) recovery for Mr. Osmar Garcia for a major car accident injury he suffered in West Palm Beach, Flordia.

In this car wreck, Mr. Garcia, a hard-working elevator technician, loving father and husband, was involved in a rear end motor vehicle accident which resulted in serious back surgery after therapy proved unsuccessful.

After initial negotiations fell through due to a minimal offer, attorney Erik Alvarez was brought in to co-counsel by the initial handling attorney. Erik Alvarez and our auto accident injury firm promptly secured a 2 Million Dollar Recovery for Mr. Garcia and his family.

It is incredibly beneficial to document the car accident scene. Taking video or photographs will help in proving up both liability and damages.

Florida Rear End Collision Presumption Law:

Although in rear end collisions there is a presumption of negligence on the part of the driver of the rear vehicle which ca only be rebutted by a showing of negligence on the part of the vehicle in the front. Birge v. Charron, 107 So. 3d 350, 362 (Fla. 2012),  articulated the position that explaining that if “evidence is produced from which a jury could conclude that the front driver was negligent, the presumption is rebutted and submitted to the jury. Examples would be that the driver of the first vehicle “stopped suddenly” or that they reversed into the rear driver.
